Apple will stop selling Series 9 Ultra 2 smartwatches in the US over Patent dispute

Apple Pauses its Sales in the US

The International Trade Commission (ITC) has the authority to prevent Apple from importing its Apple Watches if it determines that the gadgets violate on the patent rights of medical technology company Masimo.

To resolve a patent disagreement regarding the technology underlying the blood oxygen feature on the devices, Apple declared that it would be stopping the sale of its Series 9 and Ultra 2 smartwatches in the US as of this week.

According to the Biden administration’s Office of the U.S. Trade Representative, Ambassador Katherine Tai “is carefully considering all factors in this case.”The watch’s sales will be suspended, according to the company, from its beginning on December 21 and Apple retail stores following December 24. The disagreement has no bearing on other models that do not have the blood oxygen sensor, such as Apple’s less expensive Apple Watch SE model.

What the vice president for research firm IDC’s Said,

President Joe Biden is reviewing the decision through December 25, Apple has stated that it is taking proactive measures to comply if the ruling is upheld. The White House opted not to respond. The company announced that it would stop selling the watches on its website on December 21 and at Apple retail stores on December 24. The dispute has no bearing on other models that do not have a blood oxygen sensor.

The full effect of the ruling, if it stands, will be felt in January and February, which are usually some of Apple’s slowest months for sales in the United States, Ryan Reith, the program vice president for research firm IDC said that mobile device tracking efforts, Apple Watch sales during the holiday season in the United States won’t be negatively impacted, and if the ruling stands, its full effect will be felt in January and February, which are normally some of the company’s slowest months for sales in the country.

According to Reith, “Apple will have products offered during that time because they have a lot of stock of Watch 8 and SE.” Apple will be able to use the in-question blood oxygen sensor technology in future products or if they will need to settle out of court or find an alternative. He also stated that U.S. holiday sales of Apple Watches will not be negatively impacted.

Apple’s stock fell 1.4% following the News

According to Counterpoint Research, Apple holds roughly 25% of the worldwide smartwatch market. During the U.S. and European holiday sales, this share typically rises to more than a third in the fourth quarter. Outside of the US, the Series 9 and the Ultra 2 would continue to be sold, even in Asia during the Lunar New Year holiday.

Apple said it plans to file an appeal with the Federal Circuit, arguing that the ITC’s conclusion was incorrect and ought to be overturned. Masimo has charged Apple with taking its pulse oximetry technology, hiring away its staff, and putting it into the well-known Apple Watch.

Apple has filed a separate lawsuit against Masimo in a Delaware federal court for patent infringement. Apple refers to Masimo’s legal actions as a “move to clear a path” for its rival smartwatch.

Since President Barack Obama’s administration reversed the import restriction on Apple’s iPhones and iPads due to a patent dispute with Samsung in 2013, no presidential administration has vetoed an ITC ruling.

In February, the Biden administration declined to block a separate import prohibition on Apple Watches due to a complaint from the medical technology company AliveCor regarding patent infringement. For additional reasons, the ITC has banned hold.

A company report states that in the third quarter of 2023, Apple’s wearables, home, and accessory business which encompasses the Apple Watch, AirPods earbuds, and other products generated $8.28 billion in revenue.
