Apple Pauses its Sales in the US

The International Trade Commission (ITC) has the authority to prevent Apple from importing its Apple Watches if it determines that the gadgets violate on the patent rights of medical technology company Masimo.

To resolve a patent disagreement regarding the technology underlying the blood oxygen feature on the devices, Apple declared that it would be stopping the sale of its Series 9 and Ultra 2 smartwatches in the US as of this week.

According to the Biden administration’s Office of the U.S. Trade Representative, Ambassador Katherine Tai “is carefully considering all factors in this case.”The watch’s sales will be suspended, according to the company, from its beginning on December 21 and Apple retail stores following December 24. The disagreement has no bearing on other models that do not have the blood oxygen sensor, such as Apple’s less expensive Apple Watch SE model.

Apple said it plans to file an appeal with the Federal Circuit, arguing that the ITC’s conclusion was incorrect and ought to be overturned. Masimo has charged Apple with taking its pulse oximetry technology, hiring away its staff, and putting it into the well-known Apple Watch.

Apple has filed a separate lawsuit against Masimo in a Delaware federal court for patent infringement. Apple refers to Masimo’s legal actions as a “move to clear a path” for its rival smartwatch.

Since President Barack Obama’s administration reversed the import restriction on Apple’s iPhones and iPads due to a patent dispute with Samsung in 2013, no presidential administration has vetoed an ITC ruling.

In February, the Biden administration declined to block a separate import prohibition on Apple Watches due to a complaint from the medical technology company AliveCor regarding patent infringement. For additional reasons, the ITC has banned hold.
