Apple filed an appeal with the federal court After the White House failed to veto in Smartwatch ban

Apple announced that it would challenge the US government’s ban on its most recent wristwatch models, following the Biden administration’s decision not to veto a decision regarding patent infringement. The Apple Watch Series 9 and Apple Watch Ultra 2 are no longer offered in stores or online as of Tuesday when the company’s most recent wristwatch devices were outlawed.

The prohibition is the latest development in the high-profile legal battle between Google and Sonos over patents; the two firms have also been engaged in a legal battle over speaker technology.

Apple is challenging a US sales restriction on its smartwatches after the White House declined to reverse the decision, attempting to protect a company that brings in about $17 billion annually.

A patent dispute led Apple to file an action with the US International Trade Commission.

Apple plans to file a lawsuit in the US Court of Appeals to argue against the US International Trade Commission’s prohibition stemming from a patent dispute. Additionally, the business filed an emergency request on Tuesday asking the court to lift the ban on watch sales while it reviews its appeal.

Apple finds itself in the unique situation of having to struggle to get one of its iconic products back on shop shelves due to a patent dispute with healthcare firm Masimo Corp. With a blood-oxygen detector in its watches, Apple violated two Masimo, health-technology patents, the ITC found in October.

US Trade Representative Katherine Tai will decide whether to lift the import ban after giving the White House sixty days to evaluate it. That review’s time just ran out.

The Office of the US Trade Representative released a statement on Tuesday that stated, “After careful meetings, Ambassador Tai opted not to reverse the ITC’s determination and the ITC’s decision became final on December 26, 2023.”

Apple had already withdrawn the sale of its Series 9 and Ultra 2 timepieces from both its US retail locations and online shop. The final day to purchase a new watch at an Apple outlet was Christmas Eve, while online sales were discontinued on December 21.

Apple Watch Series New Software Update

For the Apple Watch, Apple has created a software update that it hopes will address the problem. It has sent the update’s design to the US Customs Department and stated in a filing on Tuesday that the government will decide on Jan. 12 regarding whether or not to accept the modifications. Should the verdict be in Apple’s favor, the watch models might be sold again.

The court order against Apple forbids both the importation of the devices into the US and the sale of the products through its retail outlets. The products can be sold by other stores.

The majority of Apple’s watch sales are made up of the Series 9 and Ultra 2 versions. The less expensive Apple Watch SE, which is still available for purchase, lacks the blood-oxygen functionality. Last week, Apple informed employees that they could not inform customers that the Ultra 2 and Series 9 are still available for purchase through unofficial Apple retail channels because of the ongoing legal dispute.

Apple Is Taking Action To Bring back their Smartwatches

Every iteration of the Apple Watch, which leads the smartwatch market, has seen a steady increase in fitness and health functions. The Apple Watch Series 9 was introduced in September, with the company claiming improved performance in addition to capabilities like the capacity to view and record health data.

“We completely disagree with the USITC judgment and accompanying inclusion order and have initiated every step to return Apple Watch Series 9 and Apple Watch Ultra 2 to our clients in the US shortly,” Apple declared in a statement on Tuesday.

Masimo “mistakenly tried to use the ITC to keep a possible saving device from millions of Americans while preparing the way for their watch that duplicates Apple,” according to Apple at the time of the first verdict. A mistrial was declared in May following a jury that was unable to reach a unified decision about Masimo’s charges.
